Legal

The rules of the marketplace.

Last updated: 12 October 2026

Who these terms apply to

These Terms of Service govern the use of BigSocials, an AI-matched creator marketplace operated by BigSocials Technologies Pvt. Ltd. from Kochi, Kerala, India. By creating an account, signing in, or using the platform in any way you agree to these terms.

You must be at least 18 years old to use BigSocials. If you are signing up on behalf of a brand or company, you confirm that you are authorised to bind that entity to these terms.

The three roles

  • Brands create campaign briefs, review AI-matched creator suggestions, send invitations, evaluate submissions, and pay via Razorpay escrow.
  • Creators onboard with phone OTP and Instagram OAuth, respond to invitations, submit work as Google Drive links, and receive payouts to their registered UPI VPA.
  • Administrators verify brand and creator accounts, moderate campaigns, and resolve disputes.

Account responsibilities

You are responsible for keeping your sign-in credentials secure, providing accurate profile information, and using the platform in good faith. We may suspend or terminate accounts that submit false information, abuse rate limits, attempt to circumvent the matching system, or violate the rights of other users.

Payments and escrow

Payments are processed by Razorpay. When a brand pays for a campaign winner, the amount sits in Razorpay escrow until the brand confirms the work is delivered, at which point we release the payout to the creator (less the platform commission disclosed during checkout).

Refunds, cancellations, wallet balances and creator withdrawals are explained in our refunds, cancellations and payouts policy, which forms part of these terms. We will mediate good-faith disputes between brands and creators on the platform; our decision on how escrowed money is handled is final on the platform, without limiting either party’s rights under Razorpay’s dispute process or the law.

Plans and fees

Some features need a paid plan. The price, billing period and platform commission are shown before you pay. Taxes, including GST, are added where they apply. You are responsible for the taxes on your own earnings.

Content ownership and licence

Creators retain ownership of the content they produce. Submitting a Google Drive link as part of a campaign grants the brand an irrevocable, worldwide licence to use that specific submission for the campaign’s stated deliverables. Any wider use (e.g. paid amplification, ad creative re-use, brand-owned re-posts) requires a separate agreement.

Brands keep ownership of their briefs, brand assets, and any feedback they provide. By submitting content via BigSocials you confirm you have all necessary rights to it.

Instagram and third-party data

We integrate with Instagram via the Meta Graph API. The Instagram data we read on your behalf is governed by Meta’s Platform Terms in addition to these terms. You can disconnect your Instagram connection at any time from your dashboard, and you can request deletion of the data we hold by visiting our data deletion page.

Comment and message automations

Creators can set up rules that reply to comments and send a direct message on their own Instagram posts. You are responsible for the rules you create and the messages you send. You must follow Instagram’s and Meta’s terms and policies, message only people who commented on your post, and not use automations to spam, mislead or harass anyone. We may pause an automation that breaks these rules or that Meta restricts.

AI-generated suggestions

Matches, rankings, scores, analyses and drafts are produced with AI and can be wrong or incomplete. Treat them as suggestions. You remain responsible for your own decisions, including which creators you invite, which work you accept and what you publish.

Prohibited use

  • Buying followers, faking engagement, or otherwise misrepresenting audience metrics.
  • Soliciting users to transact outside the platform to evade the platform commission.
  • Hate speech, sexual content involving minors, harassment, or content that violates Indian law.
  • Reverse-engineering, scraping, or otherwise interfering with the AI matcher or platform infrastructure.

Suspension and termination

You can stop using BigSocials and delete your account at any time (see our data deletion page). We may suspend or end an account that breaks these terms or the law. Money already held for completed work is still handled under the payments policy.

No warranties

BigSocials is provided “as is”. We do not guarantee that AI match suggestions will lead to successful campaigns, that creators will accept invitations, or that any specific business outcome will result from using the platform. To the extent permitted by law, we exclude implied warranties.

Liability

Our total liability for any claim arising out of or relating to these terms is limited to the platform fees you paid us in the three months preceding the claim. We are not liable for indirect, incidental, or consequential damages.

Changes to these terms

We may update these terms from time to time. We will note the last-updated date at the top of this page. Significant changes will be announced via in-app notification or email to your registered address.

Governing law

These terms are governed by the laws of India. Disputes are subject to the exclusive jurisdiction of the courts of Ernakulam, Kerala.
